WELCOME to the United States Pony Clubs, Inc. (USPC) as a Professional Member. We are excited to have you as a member. Set forth below are the terms of your membership. By accepting membership, you agree to these terms.
As a Professional Member, you now have access to copyrighted instructional materials including lesson plans and other educational materials depending upon the educational package, if any, you select. Please note, however, although you have access to various USPC materials and you are a Professional Member, you are in no way authorized to hold yourself out as an agent of USPC or otherwise hold yourself out as being certified or endorsed by USPC.
USPC retains the exclusive rights to all of its trademarks and copyrighted materials. USPC allows your limited access during the term of your membership to our instructional and educational materials solely for your individual, personal use, and you may not otherwise copy, use or distribute these materials for any commercial purpose without the express written consent of USPC. You shall not acquire any right, title, or interest in any USPC copyrights or trademarks.
Finally, you agree to indemnify, defend, and hold harmless USPC and its officers, directors, employees, parents, successors, agents, distribution partners, affiliates, subsidiaries, and their related companies (“Released Parties”) from and against any and all claims, liabilities, losses, damages, obligations, costs and expenses (including reasonable attorneys’ fees and costs) arising out of, related to, or that may arise in connection with your breach of any terms of this agreement or your acts or omissions. You agree to cooperate fully with USPC in the defense of any claim that is the subject of your obligations hereunder. You also agree that the Released Parties shall not be liable to you in any manner in connection with your use of USPC materials.
Your membership and all rights associated therewith shall terminate after one year unless your membership is renewed. USPC reserves the right to terminate your membership at any time if you violate any of the foregoing terms. Should this membership be terminated or forfeited for any reason, there will be no refund of fees, dues or other payments.
